Cutting conditional business lines under revised Investment LawAccording to Dr. Bui Quy Thuan, Head of the General Research Division at the Vietnam Industrial Park Finance Association (VIPFA), the revised Investment Law 2025 introduces a number of notable changes, among which the reduction of conditional business lines stands out as a key highlight for investors.Specifically, compared to the 2020 Investment Law, Appendix IV of the 2025 Investment Law has removed or revised the scope of several conditional business lines, including: tax procedure services; customs procedure services; insurance auxiliary services; labor outsourcing services; commercial inspection services; temporary import and re-export of frozen food; and temporary import and re-export of used goods on the restricted list.<figure class="image"><img src="https://img-ven.congthuong.vn/resize/th/upload/2026/03/02/fdi02-11115478-16092814.png" alt="The Investment Law 2025 is expected to create more favorable conditions for enterprises. Commenting on this provision, Dr. Bui Quy Thuan noted that Clause 2, Article 19 allows foreign investors to establish enterprises without a prior investment project, provided that market access conditions are met.Specifically, foreign investors may establish an economic organization to implement an investment project before carrying out procedures for issuance or adjustment of the Investment Registration Certificate, but they must comply with market access requirements applicable to foreign investors.“Under the previous regulation, an investment project had to be in place before an enterprise could be established. In addition, 280 households received housing repair support, helping to ensure safe living conditions and reduce risks from future natural disasters. Alongside this meeting, the relevant Working Groups responsible for negotiating verious chapters of the ACAFTA had been meeting since February 2, 2026, and are expected to conclude on February 13, 2026. Attending these meetings are the TNC Leads and negotiators from 11 ASEAN countries (Timor Leste was invited to attend as an observer) and Canada. According to this roadmap, the majority of negotiation chapters are expected to be concluded in the first half of 2026, while the remaining issues, particularly market access, exceptions, and dispute settlement, will be addressed in the final negotiating stage.TNC emphasized that achieving this goal requires strong political commitment, flexibility, and close coordination between the Parties at both the technical and policy levels. Drafting the decree under expedited procedures to ensure progressOn February 9 in Hanoi, the Ministry of Industry and Trade held a meeting of the drafting committee for the decree detailing several articles and measures to organize and guide the implementation of Resolution No. 253/2025/QH15 dated December 11, 2025, of the National Assembly on mechanisms and policies for national energy development in the 2026 - 2030 period. The meeting was chaired by Deputy Minister of Industry and Trade Nguyen Hoang Long. As the lead agency, the EAV prepared the first draft of the decree to solicit comments from members of the drafting committee. On December 31, 2025, the drafting committee held its first meeting to discuss the first draft. Based on the feedback received, the EAV coordinated with relevant units to absorb comments, revise, and finalize the second draft and the accompanying dossier for the decree.On January 12, the EAV reported to the Deputy Minister of Industry and Trade for consideration and approval of the decree dossier (second draft) and for the signing of the document to solicit broad-based comments. Among them, the group of regulations on offshore wind power development accounts for the largest volume, focusing on projects included in planning schemes and expected to be put into operation during the 2025 - 2030 and 2031 - 2035 periods. According to the EAV, this is the content that attracted the greatest number of comments, reflecting strong interest from ministries, sectors, local authorities and enterprises in the legal framework governing offshore wind power.Comments focus on four major groups of issuesAs of February 9, the EAV had received a total of 44 comments, including opinions from seven ministries and ministerial-level agencies, 28 provincial-level units; four units under the Ministry of Industry and Trade; and five economic groups. The Quang Ninh Department of Industry and Trade proposed adding the component “Report on the evaluation of planning implementation” in accordance with Clause 4, Article 49 of the Law on Planning.The EAV held that, for the special mechanisms stipulated in Resolution No. 253/2025/QH15, the dossier has already been compiled as a “Report on adjustment and updating of planning,” which integrates the main evaluation contents. Adding a separate dossier component could prolong the timeline and affect implementation progress. The EAV therefore proposed not adding a separate dossier component, but instead continuing to refine and clarify the evaluation content within the Report on adjustment and updating of planning.Second, regarding submission methods and the number of dossier copies. Several comments, including those from the Ministry of Justice and the Bac Ninh Department of Industry and Trade, proposed prioritizing electronic dossiers and reviewing the number of hard-copy dossiers to ensure feasibility. In response, the EAV revised the draft to stipulate that dossiers will include five hard-copy sets and one electronic set, and may be submitted in person, by post, or through electronic means. The Gia Lai Department of Industry and Trade proposed not stipulating the provision that “failure to respond by the deadline shall be deemed as agreement,” citing the lack of clarity regarding its legal validity. Meanwhile, other opinions suggested retaining this provision to ensure progress.The EAV considered it necessary to continue applying the mechanism whereby failure to provide comments by the deadline is understood as agreement, given the implementation of the resolution under expedited procedures. However, to ensure rigor, the draft has been revised to clarify response obligations and the accountability of consulted agencies and units for matters within their management responsibilities.Fourth, regarding transitional provisions for offshore wind power projects. The Vietnam National Industry and Energy Group, Copenhagen Infrastructure Partners of the Kingdom of Denmark, and the Ministry of Agriculture and Environment proposed adding transitional provisions for applications seeking sea area allocation to survey offshore wind power projects for the 2025 - 2030 period that are currently under review.According to the EAV, many applications are currently being processed by the Ministry of Agriculture and Environment, with a total proposed capacity exceeding 6,000MW. If transitional provisions are added, certain new regulations of the decree may not apply to these projects, potentially affecting the objective of accelerating offshore wind power development in the 2025 - 2030 period.<blockquote>The EAV proposed that, at the third meeting of the drafting committee, members from the Ministry of Agriculture and Environment provide comprehensive information on the number of applications, proposed capacity scale, processing timelines, and reasons for prolonged processing. The Vietnam Trade Office in Poland reported that from 2026 and in the following years, Poland will further tighten food safety inspections at border checkpoints before allowing goods to enter the domestic market.Specifically, at the year-end 2025 review and task deployment meeting for 2026 of the Agricultural and Food Quality Inspection (IJHARS), Dorota Bochenska, Chief Inspector, noted that in 2025 IJHARS conducted numerous quality inspections on agricultural and food products imported from non-EU countries. Many consignments found in violation of Polish regulations were ordered to be destroyed or re-exported.Common violations identified in agricultural and food products imported from third countries included incorrect labeling, such as the absence of Polish-language information, missing or incomplete ingredient lists, and inaccurate indications of minimum durability dates. <figure class="image image_resized" style="width:777px;"><img src="https://bcp.cdnchinhphu.vn/thumb_w/640/344443456812359680/2026/1/15/hop-17684429453361403494189.jpg" alt="Net-zero emission by 2050 is commitment to action: Prime Minister - Ảnh 1."></figure>Prime Minister Pham Minh Chinh (standing) chairs the 6th meeting of the National Steering Committee for implementing Viet Nam's commitments at the COP26, Ha Noi, January 14, 2025 - Photo: VGPThe Government leader presided over the 6th meeting of the National Steering Committee for implementing Viet Nam's commitments at the COP26 in Ha Noi on January 14.Pham said, the net-zero emission target is a political mission of the nation and a responsibility shared by the entire political system, the business community, and every citizen.Since 2022, the number of electric cars in Viet Nam has increased more than 28-fold, to a total of 270,000 vehicles, while electric buses have increased fourfold to a total of 1,187 vehicles.Nearly 600 buildings have been certified as green buildings nationwide.Viet Nam has completed the procedures to become an official member of the International Solar Alliance (ISA) and participate in the International Renewable Energy Agency (IRENA).By the end of 2025, outstanding green credit reached over VND 750 trillion (US$28.54 billion), up 10.3 percent compared to the end of 2024.The Prime Minister outlined five key groups of tasks for the period ahead, including:(i) Improving the institutional framework in line with the country's conditions and circumstances and international regulations;(ii) Developing mechanisms and policies to mobilize financial resources for green development;(iii) Establishing regulations for the transfer of advanced technologies to serve green development, while promoting science and technology, and innovation;(iv) Building a national governance model for green and smart development;(v) Training human resources for green development.Regarding the promotion of greenhouse gas emission reduction, Pham called for the early pilot implementation of emission quota allocation and the implementation of the Nationally Determined Contributions (NDC).He underscored the need to make thorough preparations for the operation of the domestic carbon market, including the exchange of greenhouse gas emission reduction outcomes and carbon credits.The Ministry of Construction was tasked to develop a roadmap for greening the transport sector, while ministries, sectors, and localities accelerate the implementation of tasks related to the transfer of advanced technologies to electrify transport and develop green transport and green infrastructure.The Government chief also highlighted the significance of enhancing the development of renewable energy, a just energy transition, green finance and credits./.
